Prosecutor of the Ministry of Justice: Strengthening compliance is not sufficient to serve as a reason for leniency in punishing encryption exchanges.
Recently, a prosecutor from the Ministry of Justice expressed his views on a certain Crypto Assets trading platform case. He stated that although the relevant parties did indeed take measures to strengthen Compliance after the incident, this is merely a responsibility that should be fulfilled and is not sufficient to serve as a reason for a lighter penalty. The prosecutor emphasized that this case does not equate the defendants with individuals involved in other well-known Crypto Assets cases, but he also pointed out that if probation is applied to such cases, it may encourage more illegal activities and even lead to an expansion of the scale of violations.
Previously, the judge responsible for the case indicated that he generally agrees with the sentencing recommendations proposed by the probation office. Specifically, a sentence of 10 to 16 months in prison may be imposed, along with a supervised release period of 1 to 3 years.
This judicial trend has attracted widespread attention in the industry, not only concerning the specific handling of this case but also relating to the compliance development direction of the entire Crypto Assets industry. The industry generally believes that the final judgment of this case may have a profound impact on the handling of future related cases.
